These Terms of Service ("Terms") govern your access to and use of the products, services, and websites provided by App Riders LLP ("App Riders," "we," "us," or "our"), including the Dant Upchaar™ Patient Care App, Doctor App, and Clinic Management App (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Services.
Which terms apply to you. App Riders LLP operates products under distinct brands. If you use the Dant Upchaar™ platform — the Patient Care App, Doctor App, Clinic Management App, or dantupchaar.com — the Dant Upchaar Terms of Service apply to that platform and prevail over these Terms to the extent of any inconsistency. These Terms govern www.appriders.com and any App Riders service for which no product-specific terms have been published. App Riders LLP is the contracting party in every case.
1. Acceptance of These Terms
By accessing and using the Services, you acknowledge that you have read these Terms and agree to all their terms and conditions. By continuing to access and use the Services, you agree to be bound by these Terms. If you do not agree to abide by the terms of these Terms, you are not authorised to access or use the Services. These Terms constitute a legally binding agreement between you and App Riders LLP.
2. Eligibility
You must be at least 18 years of age to create an account. Persons under 18 may use the Services only with verifiable parental consent, in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act). Healthcare professionals must hold valid registration with the appropriate regulatory body (e.g., Dental Council of India or respective State Dental Council).
3. Account Registration
You agree to provide accurate, complete, and current information during the registration process and to keep such information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts containing false information or found in violation of these Terms.
4. Services Description
App Riders provides a technology platform connecting patients, dental healthcare providers, and clinic administrators. Important: App Riders is a technology platform, not a healthcare provider. We do not provide medical advice, diagnosis, or treatment. All medical decisions remain the sole responsibility of the licensed healthcare professional and the patient. The Services are not intended for medical emergencies. If you experience a dental or medical emergency, contact local emergency services immediately.
5. User Content
Our Services allow you to submit, upload, store, or share content, including but not limited to health records, treatment notes, images, reviews, and other materials ("User Content"). You retain ownership of your User Content. By submitting User Content through the Services, you grant us a limited, non-exclusive, royalty-free licence to use, process, store, and display such content solely for the purposes of operating and delivering the Services to you — such as displaying your profile to patients, processing treatment records, and facilitating appointment workflows. This licence terminates upon deletion of the relevant User Content or closure of your account, except where retention is required by law.
You are solely responsible for the User Content that you submit through the Services, and you represent and warrant that: (a) you own or have the necessary rights and permissions to use and authorise us to use all intellectual property rights in your User Content; (b) you have the consent of any person featured in your User Content; (c) your User Content does not violate the privacy rights, publicity rights, copyrights, or other rights of any person or entity; and (d) your User Content, including reviews and ratings, does not disclose sensitive personal information of third parties.
We reserve the right to review, moderate, and remove User Content that violates these Terms, applicable law, or professional ethics standards.
6. Acceptable Use
You agree not to use the Services in any way that is unlawful, harmful, or otherwise objectionable. You specifically agree not to:
- Violate any applicable local, state, national, or international law or regulation, or any rights of any third party
- Upload false, misleading, defamatory, or fraudulent information
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
- Attempt unauthorised access to any part of the Services, other users’ accounts, or any computer systems or networks connected to the Services
- Transmit malware, viruses, worms, trojans, or any harmful or disruptive code
- Scrape, crawl, index, or use automated means to access the Services without our prior written permission
- Use health data for purposes other than treatment, or disclose another user’s health data without proper authorisation
- Interfere with or disrupt the integrity or performance of the Services
7. Healthcare Professional Obligations
Healthcare professionals using the platform acknowledge and agree to:
- Maintain valid professional registration with the appropriate regulatory body throughout their use of the platform
- Comply with the Telemedicine Practice Guidelines (2020) where applicable to teleconsultation features
- Provide accurate, complete, and timely treatment records and prescriptions
- Maintain patient confidentiality in accordance with applicable medical ethics standards and data protection laws
- Not use the platform to provide advice or services outside their area of licensure or expertise
- Ensure that all content, including professional listings and descriptions, complies with the Dentists Act, 1948, the DCI Code of Ethics, 2002, and other applicable professional regulations
8. Payments and Fees
Fees for paid features of the Services are displayed before purchase in Indian Rupees (INR). Payment processing is handled through secure third-party payment gateways compliant with applicable security standards. All applicable taxes, including Goods and Services Tax (GST), are added where required by law. Fee changes will be communicated at least 30 days in advance of taking effect.
9. Backups
We perform regular backups of data stored on our servers. However, backups are provided for our own administrative purposes and are not guaranteed. You are responsible for maintaining your own backup of your User Content. We shall not be responsible for any loss, corruption, or unavailability of data, including User Content, whether caused by system failure, user error, or any other reason. We recommend that you keep independent copies of important records and data.
10. Intellectual Property
All intellectual property rights in and to the platform — including our proprietary software, platform design and user interface, App Riders and Dant Upchaar branding, and documentation — are owned by or licensed to App Riders LLP. User Content remains your property. You retain full ownership of all intellectual property rights in content you upload to the Services.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services strictly for their intended purpose. This licence does not include the right to: (a) modify, copy, or create derivative works based on the Services; (b) reverse-engineer, disassemble, or decompile any software used in the Services; or (c) use any data mining, robots, or similar data-gathering tools.
11. Accuracy of Information
While we make every reasonable effort to ensure that the information presented through the Services is accurate and up to date, we do not warrant the completeness, reliability, or accuracy of any information available on or through the Services. Any reliance you place on such information is strictly at your own risk. We disclaim all liability arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.
12. Third-Party Services
The Services may contain links to or integrate with third-party websites, applications, services, or content that are not owned or controlled by App Riders ("Third-Party Services"). We have no control over, and assume no responsibility for, the content, privacy policies, practices, or availability of any Third-Party Services. Your use of Third-Party Services is governed by the terms and conditions and privacy policies of those services. We encourage you to read the terms and privacy policies of any Third-Party Services that you visit or interact with. We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any Third-Party Services.
13. Links to Other Resources
Although the Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. We are not responsible for examining or evaluating the offerings of any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties.
14. Disclaimer of Warranty
You agree that your use of the Services is solely at your own risk. The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. App Riders LLP, its subsidiaries, affiliates, and licensors do not warrant that:
- The Services will function uninterrupted, secure, or available at any particular time or location
- Any errors or defects will be corrected
- The Services are free of viruses or other harmful components
- The results of using the Services will meet your requirements
- Any health information or medical content is a substitute for professional medical advice, diagnosis, or treatment
15. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall App Riders LLP, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation: loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to, use of, or inability to access or use the Services
- Any conduct or content of any third party on the Services
- Any User Content obtained from the Services
- Unauthorised access, use, or alteration of your transmissions or content
- Medical outcomes arising from interactions facilitated through the platform
Our total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. The limitations of this section shall apply regardless of the form of action, whether based on warranty, contract, tort, statute, or any other legal theory, and whether or not App Riders LLP has been informed of the possibility of any such damages.
16. Indemnification
You agree to indemnify, defend, and hold harmless App Riders LLP, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable legal fees, resulting from: (a) your violation of these Terms; (b) your use of the Services; (c) your User Content; (d) your violation of any rights of a third party; or (e) any claim that your User Content caused damage to a third party. This indemnification obligation will survive the termination of these Terms and your use of the Services.
17. Termination
We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. You may terminate your account at any time through the in-app settings or by emailing support@appriders.com. Upon termination, your right to use the Services will cease immediately. Data retention and deletion post-termination is governed by our Privacy Policy. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
18. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall first be resolved through good-faith negotiation between the parties. If the dispute is not resolved through negotiation within 30 days, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, and the seat of arbitration shall be in India. The language of arbitration shall be English. The arbitral award shall be final and binding upon both parties.
19. Governing Law
These Terms and any separate agreements whereby we provide you the Services shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions. Subject to the arbitration clause above, the courts of India shall have exclusive jurisdiction over any disputes.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Any such provision shall be deleted without affecting the remaining provisions herein, and the remaining provisions shall continue in full force and effect.
21. Assignment
You may not assign, transfer, or sub-licence any or all of your rights or obligations under these Terms to any third party without our prior written consent. We may assign, transfer, or sub-licence our rights and obligations under these Terms without restriction and without notice to you, including in connection with any merger, acquisition, or sale of assets.
22. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice within the Services at least 15 days before taking effect. Your continued use of the Services after the effective date of the revised Terms will constitute your acceptance of those changes. It is your responsibility to review these Terms periodically. If you disagree with the updated Terms, you must stop using the Services and may request account deletion.
23. Platform Display Licence
By making your profile, clinic information, or other User Content available through the Services, you permit other registered users to view such content within the Services for the platform’s intended purpose.
24. Copyright and Intellectual Property Claims
We respect the intellectual property rights of others. If you believe that any content on the Services infringes your copyright or other intellectual property rights, you may submit a written notice to support@appriders.com with: (a) identification of the work claimed to have been infringed; (b) identification and location of the allegedly infringing material; (c) your contact information; and (d) a good-faith statement that the use is not authorised by the rights holder. We will investigate promptly and, where appropriate, remove or disable access to the material in question.
25. Restricted Use of Third-Party Information
You may access other users’ personal information displayed through the Services only for the platform purposes for which it is made available. You may not export, copy, scrape, or use such information for any purpose outside the Services. Violation of this provision may result in immediate suspension or termination of your account.
26. Force Majeure
Neither party shall be liable for any delay or failure to perform obligations under these Terms resulting from events beyond reasonable control, including natural disasters, pandemics, government actions, internet disruptions, or other force majeure events.
